Terms of Service

These Terms of Service ('Terms') govern your access to and use of the Skye Estate mobile application and website (together, the 'Service'), operated by Individual Entrepreneur Artur Zhaldakou, Tax ID 345831736, registered in Georgia ('Skye Estate', 'we', 'us', or 'our'). By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About Skye Estate and the Operator

The Service is operated by Individual Entrepreneur Artur Zhaldakou (Tax ID: 345831736), registered with the LEPL National Agency of Public Registry, with a registered address at Georgia, Batumi city, Airport Highway Street, N 186, Apartment N33.

Skye Estate is a rental-listings aggregator: we collect publicly available listings from open Telegram channels and structure them using automated and AI tools (price, district, rooms, amenities, owner contacts) to present them in a single catalogue with a map, filters and search. Skye Estate is an information service only and is not a real-estate agency, broker, or a party to any rental transaction.

2. Eligibility (18+)

The Service is intended solely for individuals who are at least 18 years old. By using the Service you represent and warrant that you are 18 or older. We do not knowingly provide the Service to, or collect data from, persons under 18.

3. Your Account

To unlock owner contacts, post listings, or make purchases you must sign in with Google or Apple. You are responsible for keeping your account credentials secure and for all activity under your account. You may delete your account and associated data at any time from your profile in the app, or by writing to support@skye.estate.

4. Licence and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial purposes. You agree not to use the Service for any unlawful purpose, not to post false, fraudulent or misleading listings, not to infringe the rights of others, and not to attempt to bypass the paid contact gate or any other access control or technical limitation. We may hide or remove any content and suspend or terminate accounts that violate these Terms.

5. Prohibited Use of Data (Anti-Scraping)

You may not, and may not permit any third party or automated agent to: scrape, crawl, harvest, index, cache, mirror, bulk-download, or otherwise systematically extract or copy listings, contacts, or any other data from the Service; access the Service through any bot, script, or data-mining tool; or reproduce, resell, redistribute, or commercially exploit any part of the Service or its data without our prior written consent. Unauthorised scraping or extraction is a material breach of these Terms and may result in immediate termination and legal action.

6. Listings and Sources

Listings are aggregated from public Telegram channels and are provided on an 'as is' basis. We do not verify and do not guarantee the accuracy, completeness, availability, or legality of any listing. You are solely responsible for independently verifying any property, owner, or counterparty before paying any deposit, transferring funds, or signing any agreement.

To keep results fresh, Skye Estate only shows recent listings: a listing is displayed for up to 30 days from the date it was posted, after which it is automatically removed from the catalogue. This applies to all listings, including realtor-submitted and promoted ones; paid posting or promotion does not extend a listing beyond this 30-day window.

7. Paid Plans, Subscriptions and Auto-Renewal

The Service offers one-time purchases (such as contact credits, listing credits, priority and channel placement) and recurring subscription plans. Subscription plans are offered on a Monthly basis (billed every month) and an Annual basis (billed every twelve months). Current prices and benefits are shown in the app and on the website at the point of purchase.

Subscriptions are auto-renewing. Unless you cancel, each subscription automatically renews for another period of the same length at the then-current price, and your payment method is charged at the start of each new period. For purchases made through the App Store or Google Play, the charge is taken within the 24 hours before the current period ends and renewal is handled by Apple or Google.

You can turn off auto-renewal at any time: for in-app purchases, in your Apple App Store or Google Play subscription settings; for purchases made on our website, from the account profile section. Cancellation stops future renewals — your access continues until the end of the period already paid for. We may change prices or plan features; material changes apply from the next renewal and we will give notice where required. Refunds are governed by our Refund Policy.

8. Mobile Application Terms (Apple and Google)

These Terms are concluded solely between you and Skye Estate, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content and have no obligation to furnish any maintenance or support for it.

To the maximum extent permitted by law, Apple and Google provide no warranty for the application and are not responsible for addressing any claims relating to it, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or privacy law. Any such claims, and responsibility for the app, are Skye Estate's responsibility as set out in these Terms.

You represent that you are not located in a country subject to a relevant government embargo and are not on any restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you. You must also comply with the applicable App Store and Google Play terms.

9. Disclaimers and Limitation of Liability

The Service is provided 'as is' and 'as available', without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Skye Estate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or in connection with your use of the Service, including any decision made on the basis of a listing.

10. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by and construed in accordance with the laws of Georgia, without regard to its conflict-of-laws rules. The courts of the city of Batumi, Georgia shall have exclusive jurisdiction. The Service is operated by Individual Entrepreneur Artur Zhaldakou (Tax ID: 345831736), registered with the LEPL National Agency of Public Registry, with a registered address at Georgia, Batumi city, Airport Highway Street, N 186, Apartment N33.

11. Changes to These Terms

We may update these Terms from time to time. Material changes are reflected in the 'Last updated' date at the top of this page, and where required we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
